* We reported earlier that these Senators were considering introduction of this foreign worker restriction bill in the Senate. Here we go. This bill was introduced in the Senate late last week. As seen in the summary of Senator Durbin, this bill proposes to apply to all the employers the restrictive portion of the current H-1B rule that applies only to the H-1B dependent employers. Together with the USCIS announcement of FY 2008 H-1B cap exhaution in one day, this legislative bill casts a dark shadow over the foreign worker immigration system. In a way, it is a frontal assault on the immigration of foreign professional workers. Please stay tuned to this web site for our summary of this nightmarish bill. This makes no sense to me. 300K LC was pending @backlog centers and all of them have PD 2005 and earlier. Non RIR was processed at the end and 90% of them are EB3. Considering 50% ROW, at least 100K EB3 ROW LCs out there with PD 2005 and earlier. And then comes the PERM LCs. At least another 50K EB3 ROW PERM LCs with PD 2005 out there. With limited EB3 ROW available visa each year (140K total, after retrogressed countries and spill over etc, not more than 40K each year), I see no reason for USCIS to move ROW to current.
According to attorney Ron Gotcher Eb2 India will move up in coming months and EB3 ROW (Rest Of the World) will be current very soon. In that case, the excess EB3 ROW numbers will go to heavily retrogressed countries. This attorney's prediction is 100% correct for the April VB.

It would be great if USCIS clarifies on interim EAD and what the applicant can do if a EAD application remain in pending status.
there are no Interm EADs (stopped almost 2 years ago) and if the EAD is pending, then you need to stop working once your old EAD expires.

When you get 485 approval you will not need EAD or AP :D
It's OK to file for EAD and AP yourself, I did it 4 times but you need I-485 receipt notice and I-140 receipt and then approval notice to do that. So if you are wiling to wait till your lawyer get notices (it could be months for those who are filing in July) and your employer and lawyer will provide you a copy of all notices - it's fine to file yourself.

On the other hand- Watch out Obama's economic recovery plans, they punish every person who is successful by virtue of his hardwork and will add debt on US books.. I am sure Obama would be driving out innovation from this country by joining hands with Anti-Captalist and Anti-business lobby.

I called USCIS this morning and the lady took 3 mnute to explain me why the delay was happening. She mentioned that they will conduct a sweep on Fri Apr 4th to determine the I-485 cases in light of new visa bulletin and that cases will be assigned to IOs by Mon Apr 14th.
Not that I believe on help desk type of info with their primary job is get the caller off the phone but I have to admit that she was polite.
I will call again on Apr 4th and keep the forum updated.

Yes, there are other ways that in an emergency you can keep in touch with IV. Total waste of valuable money, for the couple of occasions it has happened
I dont really care about the website outages. Thats not the main issue. Two or three core/senior volunteers are always running a contribution drive. Imagine thse people doing some thing more productive than running funding/media drives. When shyt hits the roof, we have a boat load of people asking when the hell shyt is gonna be all over us or how to wipe off the shyt. IV's strength lies in its members and all the time IV members have not responded to enroll in a monthly payment. People want GC's, but they dont want to pay for the fight. People want GC's but they want accountability for 20USD. People have point specific issues about themselves and their imigration issues and are happy to leverage the knowledge of the IV community, but do not care a damn about IV community. Those who pay, pay twice, pay thrice and even more. Why should any one do it? Why should others just simply browse and get answers for persoanl point specific issues? Those who do not know the value of green and what it can do in America, should stop worrying about GC. We have become a laughing stock for people on anti forums like alipac who have arrived at the conclusion that they dont need to fight us because we fight among us big time. Enough of my rant.

Looks like contacting senator/congressman is pissing off the IOs and they are issuing the RFEs. I wish now that I did not do either of these. But unfortunately I did so I guess I need to bear the consequences. So I should just expect RFE now. I know quiet a few people who wrote to Senators and got RFEs. I guess people in Jul/Aug really overwhelmed the TSC with Senator calls and now we have to face their wrath.

Key to happiness and peace of mind is to determine weather the things bothering you are under your control or not. The exact date when you will get your GC is not under your control, so worrying about it is useless. On the other hand making sure your applications are filed properly and in a timely manner is under your control. Similarly, getting laid off is not under your control. On the other hand it is under your control to constatntly try and acquire new skills that will make you more appealing to employers.
For things which are beyond our control, there is no point worrying. For things which are under our control, no point worrying either BECAUSE THEY ARE UNDER OUR CONTROL!!!
